Welcome to GetFeed! These Terms of Use ("Terms") govern your access to and use of GetFeed's AI-powered video repurposing platform, including our website, services, and applications (collectively, the "Service"). By accessing or using GetFeed, you agree to be bound by these Terms.

1. Service Description

GetFeed is an AI-driven video repurposing platform that enables content creators, marketing agencies, and media teams to transform long-form videos into optimized short-form clips for social media distribution. Our Service includes:

Video processing and transcription powered by Google Gemini 2.5 Flash AI
Automated clip generation with viral scoring, hashtag suggestions, and emotional analysis
Video editing tools including reframing, trimming, captions, and audio enhancements
Multi-tenant workspace management with role-based permissions
Third-party integrations for workflow automation and distribution
Analytics and performance tracking for published content
Cloud storage for processed videos, clips, and thumbnails

1.1 Service Availability

We strive to provide reliable access to our Service, but we do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

2. Account Registration and Responsibilities

2.1 Eligibility

You must be at least 18 years old to create an account. By registering, you confirm that you meet this age requirement and that all information provided is accurate and complete.

2.2 Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access or security breaches

We are not liable for losses arising from unauthorized use of your account, except where caused by our negligence.

2.3 Organization Accounts

If you create or join an organization workspace:

The organization owner has administrative control over all content and members
Your access rights are determined by your assigned role (owner, admin, or member)
Organization owners may remove members and delete content at their discretion
You agree to comply with the organization's internal policies

3. Acceptable Use Policy

3.1 Permitted Use

You may use GetFeed to:

Process videos you own or have legal rights to use
Create derivative content (clips) for legitimate business or creative purposes
Collaborate with team members within your organization
Publish content to your own social media channels or platforms

3.2 Prohibited Conduct

You may not use GetFeed to:

Upload content you do not own or lack permission to use
Infringe on intellectual property rights, copyrights, trademarks, or patents
Create or distribute illegal, harmful, defamatory, or abusive content
Upload content depicting violence, hate speech, harassment, or discrimination
Violate any applicable laws, regulations, or third-party rights
Distribute malware, viruses, or malicious code
Reverse-engineer, decompile, or attempt to extract our source code
Bypass usage limits, security measures, or access controls
Impersonate others or misrepresent your affiliation with any person or entity
Use automated systems (bots, scrapers) without prior written permission
Overload or interfere with our infrastructure or servers

3.3 Content Moderation

We reserve the right to review, monitor, and remove content that violates these Terms. However, we are not obligated to pre-screen user content and do not assume liability for user-generated material.

4. Intellectual Property Rights

4.1 Your Content

You retain all ownership rights to videos and content you upload to GetFeed ("User Content"). By using our Service, you grant us a limited, worldwide, non-exclusive, royalty-free license to:

Store, process, and display your User Content
Generate clips, transcriptions, and derivative works as requested by you
Use AI models to analyze and process your User Content
Create thumbnails, previews, and metadata

This license terminates when you delete your content from our Service, except for content already shared with third parties through integrations or published to external platforms.

4.2 AI-Generated Content

Clips, transcriptions, captions, hashtags, and other AI-generated outputs created from your User Content are considered derivative works. You own these outputs and may use them without restriction, subject to our Privacy Policy and applicable laws.

4.3 GetFeed Platform Rights

GetFeed and its licensors retain all rights, title, and interest in:

The GetFeed platform, software, and codebase
Our proprietary AI models, algorithms, and technologies
Our brand assets, logos, trademarks, and design elements
All improvements, modifications, and derivative works we create

You may not copy, modify, distribute, or create derivative works from our platform without explicit written permission.

4.4 Feedback

If you provide feedback, suggestions, or ideas about GetFeed, you grant us the right to use such feedback without compensation or obligation to you.

5. Payment Terms and Subscriptions

5.1 Subscription Plans

GetFeed offers multiple subscription tiers (Free, Plus, Pro) with varying features and usage limits. Current pricing and plan details are available at getfeed.co/pricing.

5.2 Billing

Subscriptions are billed monthly or annually based on your selection
All payments are processed securely through Stripe, our third-party payment processor
Prices are displayed in Brazilian Reais (R$) and may be subject to applicable taxes
You authorize us to charge your chosen payment method on each billing cycle

5.3 Free Trials

New users may receive a trial period with increased limits. Trial terms are specified at signup. After the trial expires, your account will revert to the Free plan unless you subscribe to a paid plan.

5.4 Refunds

Refunds are handled on a case-by-case basis. Generally:

No refunds are provided for partial billing periods
Refunds may be granted for technical issues preventing service usage

5.5 Subscription Changes and Cancellation

You may upgrade, downgrade, or cancel your subscription at any time
Downgrades take effect at the next billing cycle
Cancellations take effect immediately; no refunds are provided for unused time
After cancellation, you retain access until the end of your paid period

5.6 Usage Limits

Each plan has monthly limits for:

Clips generated
Storage capacity

Exceeding limits may result in service restrictions until the next billing cycle or until you upgrade your plan.

6. Third-Party Services and Integrations

6.1 Third-Party Platforms

GetFeed integrates with third-party services including but not limited to:

Video and social platforms (YouTube, Instagram, TikTok, X/Twitter)
Cloud storage providers (AWS S3)
Analytics and tracking tools (Google Analytics)
Customer support chat (Crisp)

Your use of these integrations is subject to the terms and privacy policies of the respective third parties.

6.2 No Endorsement

We do not endorse, control, or assume responsibility for third-party services. Integration availability may change without notice.

7. Service Limitations and Warranties

7.1 "As-Is" Service

GetFeed is provided on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

Merchantability, fitness for a particular purpose, or non-infringement
Uninterrupted, error-free, or secure operation
Accuracy, reliability, or completeness of AI-generated content

7.2 AI Output Disclaimer

Our AI models generate automated suggestions, transcriptions, and content analysis. While we strive for accuracy:

AI-generated content may contain errors, inaccuracies, or biases
Viral scores and performance predictions are estimates, not guarantees
You are solely responsible for reviewing and verifying AI outputs before publication
We do not guarantee specific results, engagement, or performance metrics

7.3 No Professional Advice

GetFeed does not provide legal, financial, or professional advice. You are responsible for ensuring your content complies with platform guidelines, copyright laws, and applicable regulations.

8. Limitation of Liability

To the maximum extent permitted by law:

8.1 Indirect Damages

GetFeed and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Lost profits, revenue, or business opportunities
Data loss or corruption
Service interruptions or downtime
Costs of substitute services

8.2 Liability Cap

Our total liability for any claims arising from your use of GetFeed shall not exceed the amount you paid us in the 12 months preceding the claim, or R$100 (one hundred Brazilian reais), whichever is greater.

8.3 Exceptions

These limitations do not apply to liability that cannot be excluded under applicable law, such as fraud, gross negligence, or willful misconduct.

9. Indemnification

You agree to indemnify, defend, and hold harmless GetFeed and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

Your use or misuse of the Service
Your User Content or violation of third-party rights
Your breach of these Terms
Your violation of applicable laws or regulations

10. Termination and Suspension

10.1 Termination by You

You may terminate your account at any time by contacting [email protected] or using the account deletion feature in your settings.

10.2 Termination by Us

We reserve the right to suspend or terminate your account, with or without notice, if:

You violate these Terms or our Acceptable Use Policy
Your account is inactive for an extended period (12+ months)
We discontinue the Service entirely
Required by law or regulatory authorities

10.3 Effect of Termination

Upon termination:

Your access to the Service will be revoked
We may delete your User Content after a reasonable grace period (30 days)
You remain liable for any outstanding fees or obligations
Sections of these Terms that by nature should survive (e.g., liability limitations, indemnification) will continue to apply

11. Data Privacy and Security

These Terms are governed by and construed in accordance with the laws of Brazil, without regard to conflict of law principles.

12.2 Jurisdiction

Any disputes arising from these Terms or your use of GetFeed shall be subject to the exclusive jurisdiction of the courts located in São Paulo, Brazil.

12.3 Informal Resolution

12.4 Class Action Waiver

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms with a new "Last Updated" date.

13.2 Notice of Changes

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and GetFeed regarding the Service.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.

14.5 Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, wars, terrorism, pandemics, or infrastructure failures.
